Under Oregon traffic law today, all travel is governed by the 'basic rule.' It says a driver cannot exceed a reasonable and prudent pace based on a variety of factors. Those include visibility, traffic, weather and road conditions. So, drivers have successfully argued that while the posted speed may be 55 mph, they could travel 70 or faster if the conditions safely allowed it. "
